1. Agreement to Terms

By accessing or using GenieBinsBrisbane.com.au (the “Website”) or placing a booking through our platform, you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before using the Website. If you do not agree to these Terms, you must not use the Website or our booking services.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and Global Genie Marketing and IT Services Pty Ltd (ABN 28 676 213 844), trading as Genie Bins Brisbane through its Genie Skip Bins brand (“we”, “us”, or “our”).

2. About Our Platform

GenieBinsBrisbane.com.au operates as a skip bin booking platform. Our role is to:

  • Accept and process skip bin hire bookings from users across Brisbane and Queensland
  • Transmit booking information to our network of local, independent supplier partners (“Supplier”) for fulfilment
  • Facilitate the connection between users and qualified local suppliers

We are a booking intermediary only. We do not directly own, operate, or deploy skip bins. The physical delivery, placement, collection, and disposal services are carried out exclusively by our independent local supplier partners.

3. Booking Process

3.1 Placing a Booking

When you submit a booking through our Website, you are requesting a skip bin hire service. Upon submission, your booking details — including contact information, service address, bin size, hire duration, and any special instructions — will be shared with one of our local supplier partners who services your area.

3.2 Booking Confirmation

A booking confirmation sent by us constitutes acceptance of your request into our system. However, final confirmation of the hire service is subject to availability from our supplier partner. Our supplier partner or their representative may contact you directly to:

  • Confirm your booking details and scheduled delivery time
  • Discuss access requirements for your property
  • Arrange bin pickup and collection
  • Address any site-specific considerations

3.3 Accuracy of Information

You are responsible for ensuring all information provided at the time of booking is accurate, complete, and up to date. This includes — but is not limited to — your contact details, delivery address, and any access instructions. We accept no liability for failed or incorrect deliveries arising from inaccurate information provided by you.

4. Role of Supplier Partners

Our local supplier partners are independent third-party businesses who fulfil skip bin hire bookings on our platform. By using our Website, you acknowledge and agree that:

  • Our supplier partners are solely responsible for obtaining and maintaining all required licences, permits, authorisations, and regulatory approvals necessary to operate skip bin and waste removal services in Queensland
  • Any permits required for placing a skip bin on a public road, council land, or other regulated area are the responsibility of either the supplier partner or the user, as applicable under local council requirements
  • Our supplier partners operate independently of Global Genie Marketing and IT Services Pty Ltd, and we do not direct, supervise, or control their operations
  • The contractual relationship for the physical service (delivery, placement, and collection) is between you and the supplier partner
  • Our supplier partner’s staff or contractors may contact you via phone or other means for service coordination purposes

5. Permits, Licences, and Regulatory Compliance

The requirement for permits to place a skip bin on public or council-managed land varies by local government area across Brisbane and Queensland. You are advised to check with your relevant local council before booking if you intend to place a skip bin on a road verge, footpath, or other public property.

Our supplier partners are required to hold all applicable licences and authorities to transport and dispose of waste materials under Queensland legislation, including the Waste Reduction and Recycling Act 2011 (Qld). We do not represent or warrant that any specific supplier partner holds any particular licence at any given time, and we encourage users to make independent enquiries where required.

6. Use of Bins

While a refuse bin is in your possession, you must not:

  • Light fires in the bin
  • Place or allow to be placed into the bin any liquids or any explosive, toxic, dangerous, hazardous or noxious materials including but not limited to asbestos, acids, solvents, minerals, greases, or liquid concrete
  • Fill any bin higher than the top of its sides, or in such a manner as to allow spillage of material from the bin either while stationary or in transit
  • Move any bin without the Supplier’s prior consent

In addition to the above, the following materials are expressly prohibited from all skip bins booked through our platform:

  • Hazardous or toxic materials, including asbestos, chemicals, solvents, or biohazardous waste
  • Flammable materials, gases, or liquids
  • Electrical equipment containing refrigerants (e.g. fridges, air conditioners)
  • Tyres (unless specifically agreed with the Supplier in writing)
  • Liquid waste of any kind
  • Medical or clinical waste
  • Any material prohibited under Queensland or Commonwealth waste regulations

Disposal of prohibited materials may result in additional charges levied by the Supplier and may be reported to the relevant regulatory authorities. We accept no liability for any fines, penalties, or costs arising from the disposal of prohibited materials.

7. Risk and Bin Damage

You will be liable to the Supplier for any damage to refuse bins which occurs while the bin is in your possession, subject to fair wear and tear. It is your responsibility to ensure the bin is kept in a safe and secure location and used only for its intended purpose.

8. Access and Ground Conditions

You are responsible for the provision of free and suitable access to and from the delivery site, including the removal and reinstatement of any local obstructions, and for ensuring suitable ground conditions for the delivery, placement, and removal of the bin.

No responsibility will be accepted by us or our Supplier for damage to any surface arising from bin delivery, placement, or collection. You should therefore take reasonable steps to protect surfaces (including paving slabs, soft ground, driveways, or lawns) before delivery takes place.

9. Pricing and Payment

Prices displayed on the Website are indicative and subject to confirmation by the Supplier. Final pricing may vary based on:

  • Bin size, hire duration, and waste type
  • Access difficulties or permit requirements at the delivery address
  • Weight overloads or additional charges for prohibited or excess materials

9.1 Payment Options

We offer two payment methods for your convenience:

  • Online Payment: You may pay securely online at the time of booking through our Website. Online payments are processed via our secure payment gateway.
  • Pay to Local Supplier: You may elect to pay the Supplier directly upon delivery or as agreed with the Supplier. In this case, payment terms are set by the Supplier and will be communicated to you at the time of booking confirmation.

Where payment is made online through our platform, we will remit the applicable amount to the Supplier after deducting any applicable platform fees. Any payment disputes related to direct Supplier payments should be resolved between you and the Supplier directly.

10. Refunds

Genie Bins Brisbane (operated by Global Genie Marketing and IT Services Pty Ltd) will provide a full refund of fees paid in respect of:

  • Any ordered services not provided due to failure or delay by the Supplier; or
  • Any services provided not being substantially the same as the services requested in the booking order,

provided you notify us of the request for refund within 5 working days of the scheduled delivery date for the service, and subject to confirmation of the failure, delay, or substantially incorrect service by the Supplier.

Refund requests should be submitted in writing to us via the contact details listed in Section 22. Approved refunds will be processed within a reasonable timeframe to the original payment method.

11. Order Cancellation and Variation

You are entitled to cancel or vary an order provided that the Supplier receives notice of cancellation or variation no less than 2 working days before the scheduled delivery date under the order.

  • A cancellation administration fee of $30.00 will apply to all cancelled orders.
  • Any variation made to your order within two working days prior to delivery will be granted at the Supplier’s sole discretion and, in addition to the administration fee, may be subject to payment of reasonable additional costs.

Genie Bins Brisbane reserves the right to cancel or vary any order if a Supplier is no longer able to provide the services set out in a booking, provided that we will first notify you and use all reasonable endeavours to procure a viable alternative to meet your requirements. In the event an order is cancelled by Genie Bins Brisbane, you will receive a full refund of any monies paid in advance for the cancelled order.

12. Warranties

Genie Bins Brisbane will pass on to you the benefit of any warranties normally given by the Supplier. Genie Bins Brisbane and the Supplier expressly exclude, to the fullest extent permitted by law, all other warranties, descriptions, representations, or conditions whether implied by law, trade, custom, or otherwise.

You acknowledge that Genie Bins Brisbane is not responsible for the quality of services provided to you by the Supplier, and that any dispute regarding those services is between you and the Supplier.

13. Limitation of Liability

The liability of Genie Bins Brisbane and the Supplier for any claim, damages, loss, or expense related to the supply of services is limited to the cost paid by you for those services, except where statute expressly requires otherwise.

To the fullest extent permitted by law, neither Genie Bins Brisbane nor the Supplier will be liable in any event — whether in tort (including negligence), contract, or otherwise — for any loss of profits or any consequential, indirect, or special damage, loss, or injury of any kind suffered by you or any other person.

In addition, Global Genie Marketing and IT Services Pty Ltd expressly excludes all liability for:

  • Any acts or omissions of supplier partners, including failure to deliver, incorrect placement, damage caused during delivery or collection, or improper waste disposal
  • Loss or damage to property arising from skip bin delivery, placement, or removal
  • Any delays, cancellations, or service failures caused by a Supplier
  • Personal injury arising from use or misuse of a skip bin
  • Loss of data, revenue, or profits arising from use of this Website

14. Force Majeure

Neither Genie Bins Brisbane nor the Supplier will be liable for any failure or delay in complying with any obligation imposed by these Terms if the failure or delay arises directly from any circumstance beyond Genie Bins Brisbane’s or the Supplier’s reasonable control, including without limitation:

  • Fire, flood, earthquake, or explosion
  • War, insurrection, or sabotage
  • Industrial disputes or strikes
  • Transportation disruptions or embargo
  • Changes in law or delays caused by government or government agencies
  • Any other event of force majeure beyond the reasonable control of the affected party

The affected party will notify the other as soon as practicable of any force majeure event and will use all reasonable endeavours to resume normal operations as soon as possible.

15. Consumer Guarantees (Australian Consumer Law)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) and that cannot be excluded by agreement. Where we are unable to exclude liability, our liability is limited to the re-supply of the booking service or payment of the cost of re-supply, at our discretion.

16. Privacy and Data Sharing

By placing a booking through the Website, you consent to us collecting your personal information (including name, contact details, and service address) and sharing that information with our relevant local Supplier for the purpose of fulfilling your booking. We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

Supplier partners may contact you directly using the contact information you provide. We are not responsible for how Suppliers use your information beyond the purpose of fulfilling the booking.

17. Intellectual Property

All content on GenieBinsBrisbane.com.au — including text, graphics, logos, trademarks, and software — is owned by or licensed to Global Genie Marketing and IT Services Pty Ltd. You may not reproduce, distribute, or use any content from this Website without our prior written consent.

18. Digital Asset Ownership and Partner Services Disclaimer

This Website, GenieBinsBrisbane.com.au, is a digital asset owned and operated by Global Genie Marketing and IT Services Pty Ltd (ABN 28 676 213 844). The Website is a digital platform and marketing asset of Global Genie Marketing and IT Services Pty Ltd.

Global Genie Marketing and IT Services Pty Ltd does not directly provide skip bin hire or waste removal services. All physical services advertised or facilitated through this Website are provided exclusively by our associated and independent supplier partners and service providers. Our supplier partners and service providers are solely responsible for:

  • Holding and maintaining all licences, permits, authorisations, certifications, and any other regulatory formalities required by the relevant local, state, territory, or Commonwealth authorities to carry out skip bin hire and waste disposal services;
  • Ensuring full compliance with all applicable laws, regulations, and standards governing waste management, transportation, and disposal in their respective operating areas; and
  • The quality, legality, and fulfilment of the physical services they deliver to users of this platform.

Global Genie Marketing and IT Services Pty Ltd makes no representation or warranty regarding the licences, authorisations, or regulatory standing of any supplier partner at any given time. Users are encouraged to make independent enquiries if they require verification of a supplier’s credentials or regulatory compliance prior to engaging their services.

19. Website Availability

We aim to keep the Website available at all times but do not guarantee uninterrupted access. We reserve the right to suspend, modify, or discontinue the Website or any part of it at any time without notice. We are not liable for any loss or inconvenience caused by Website downtime or unavailability.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland and the Commonwealth of Australia. Any dispute arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
